ORDER

CRL.M.A. 17128/2022

1. Pursuant to order dated 30.08.2022, the copy of itinerary has been supplied to the learned counsel for respondent, which has since been verified.

2. Petitioner is seeking permission to travel to Hong Kong, Dubai and Thailand for business purposes from 10.09.2022 to 15.10.2022.

3. The learned counsel for petitioner submits earlier the petitioner was permitted to travel to Dubai for the period from 07.06.2022 to 30.06.2022 on his furnishing a FDR to the extent of Rs.10.00 Lacs with an undertaking he shall report back to the learned Trial Court on 04.07.2022, failing which, the said FDR amount shall stand forfeited without giving any further notice in this regard. The petitioner has complied with all such conditions and even deposited his passport with the learned Trial Court.

4. The learned counsel for petitioner submits the petitioner undertakes to comply with all above conditions for his present visit to Hong Kong, Dubai and Thailand for business purposes from 10.09.2022 to 15.10.2022. The itinerary of petitioner has since been verified by the respondent.

In view of above, the petitioner is permitted to travel abroad to Hong Kong, Dubai and Thailand for business purposes from 10.09.2022 to 15.10.2022 on furnishing a FDR in the sum of Rs.10.00 Lacs with an undertaking he shall report back to the learned Trial Court on 18.10.2022, failing which the said FDR amount shall stands forfeited without giving any further notice in this regard. The petitioner shall also adhere to other conditions as mentioned i.e., he shall furnish his addresses during his stay at abroad; he shall authorize his counsel to receive notice on his behalf during his stay at abroad; he shall properly instruct his counsel for proceeding further in the case during his stay- in abroad and no adjournment shall be sought by his counsel for lack of instruction from accused; he shall surrender back his passport on his return from abroad; he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any custom authorities or tamper with the evidence; he shall not indulge or commit such like offence (s) again similar to the offence to which he is accused now in order dated 12.05.2022. The passport of petitioner be also released to him, in accordance with rules, in case it is lying with the learned Trial Court.

6. In view of above, the application stands disposed of.

7. Copy of this order be communicated to the learned Trial Court for information and compliance.
