Instant petition has been filed under Article 226 of the Constitution of India, seeking quashing of the letter/recovery notice dated 12.06.2019 (Annexure P-4) issued at the hands of respondent No.3 i.e.the Garrison Engineer (West), Military Engineer Services (MES) Department, Ferozepur Cantt., Punjab.

Counsel for the petitioner has been heard at length and the pleadings on record have been perused.

Apparently, the petitioner firm is a Government contractor and had been issued a work order in pursuance to a tender process at Annexure P-1. Petitioner successfully completed the work in question in the month of October 2018 and was even issued a completion certificate. Final bill was also submitted.

The impugned notice corresponds to the deposit of GST in relation to the work executed and completed and the final bill paid.

On a specific query having been put to counsel, he does not dispute the liability as regards the deposit of GST pertaining to the work.

Under such circumstances there would be no warrant for interference.

At this stage, a submission has been advanced by counsel that some indulgence may be shown to the petitioner firm by drawing out an installment schedule so that some reasonable time would be afforded for deposit of the GST amount. Even such submission cannot be accepted as no provision in support of such prayer has been cited.

Petition dismissed.
