It appears from the materials on record that the writ-applicant herein is engaged in the business of transportation. He claims to be the owner of a Truck bearing registration No. RJ14GK4863, which came to be seized by the respondents authorities alongwith the goods while in transit.
The writ-applicant is here before this Court with a prayer that his truck alongwith the goods may be released pending the final disposal of this petition.
Having heard the learned counsel appearing for the parties and having gone through the materials on record, we are of the view that the writ-applicant is entitled to some interim order. This writ-application has something to do with the Sections129 and 130 of the GST Act, 2017.
This Court is looking into the larger issue, which has been raised in a batch of writ-applications, however, as on date, we are inclined to release the conveyance and goods on the condition that the writ-applicant deposits an amount of ₹ 3,11,016/with the concerned authority. We direct the conveyance and goods shall be released immediately upon deposits of ₹ 3,11,016 only.
